HEALTH DATA PRIVACY POLICY

This Consumer Health Data Privacy Disclosure ("Disclosure") supplements the Babylist Privacy Policy and is effective as of March 31, 2024. The Babylist Privacy Policy describes the personal information that we collect and the sources from which we collect it. This additional disclosure is required by the My Health My Data Act ("MHMDA") in Washington and Nevada's Consumer Health Data Privacy law ("NV CHDP"), and applies only to personal information that may be considered "Consumer Health Data" under those laws.

Please note that data practices concerning Protected Health Information collected by Babylist (such as Baby List Health, LLC) are described in the terms and privacy disclosures specific to that service.

  1. Categories of Consumer Health Data collected. Depending on which Babylist services you interact with and the choices you make, we may collect personal information that may be considered Consumer Health Data, such as:
    • medical information should you choose to register on our site and provide us with your due date or that you are pregnant;
    • personal information collected in connection with health insurance-related features we offer, such as your health insurance information and benefits, or certain purchases made using your health insurance; and
    • information related to an illness or injury, if you bring a claim against Babylist.
  2. How Consumer Health Data may be used. We may use Consumer Health Data, such as described above, for the purpose of providing the products and services you request from Babylist, processing and delivering an order you place, providing you receipts and order information in your account, processing returns, processing claims, securing or troubleshooting Babylist services, and communicating with you.
  3. How Consumer Health Data may be disclosed. For residents of Washington, Nevada, and Connecticut, Babylist does not sell customers' Consumer Health Data to others without the further consent procedure described in those laws. We will only disclose Consumer Health Data as directed by you, for the purpose of providing the products and services you request from Babylist, or as explained in this section.
    As described in our Babylist Privacy Policy, Babylist may disclose personal information in connection with business transfers (for example, as part of a merger) or for the protection of Babylist or others (although we do not share consumer health data for reasons related to credit risk). We also employ other companies and individuals to perform functions on our behalf, such as acting on an emergency you report, processing claims, fulfilling orders for products or services, sending postal mail and email, analyzing data, and providing customer service. These service providers may have access to Consumer Health Data needed to perform their functions, but may not use it for other purposes. Some of these service providers may be affiliates of Babylist, such as Baby List Gift Card Company, LLC.
  4. How to exercise your rights related to Consumer Health Data. If you are covered by MHMDA or NV CHDP, then you may have certain rights under the law that applies to you, such as the right to access or delete personal information. If you wish to exercise any of the above rights, please visit the Babylist.com website and submit a request using our online support function or contact us as specified in the "Contact Us" section below. To help protect your privacy and maintain security, we take steps to verify your identity before granting you access to your information. We will fulfill your request within 45 days of receiving your request. Please note that your request may be limited in certain cases: for example, complying with your request would impede us from meeting our legal obligations.
    You may also have the right to appeal the denial of any of these rights by submitting a form that will be provided to you if we deny a data request. Depending on your data choices, certain services may be limited or unavailable. To ensure the security of your Babylist account, we will generally ask you to verify your request using the contact information you have already provided.
  5. Updates to this Consumer Health Data Disclosure. As our business changes, we may also update this Disclosure. You should check our website frequently to see recent changes. If we make changes, we will update the date at the top of this Disclosure. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.
